What is NJC?
The National Judicial Commission (NJC) is a proposed independent body for the appointment and transfer of judges in higher judiciary, including the Supreme Court and High Courts of India. It aims to replace the existing collegium system, which has been criticized for lack of transparency and accountability. The NJC is intended to include representatives from the judiciary, executive, and legal experts to ensure a more participatory and balanced selection process. In India, the concept of an NJC gained prominence after the 1993 Supreme Court judgment that established the collegium system, sparking debates on judicial appointments. Although a similar body, the National Judicial Appointments Commission (NJAC), was enacted in 2014, it was declared unconstitutional in 2015 by the Supreme Court. The NJC remains a topic of discussion among legal scholars and policymakers, particularly in the context of judicial reforms. It is frequently referenced in law exams like CLAT and UPSC Civil Services, where questions on appointment mechanisms appear.
