What is IDPA?
The Indian Data Protection Act refers to the legislative framework governing the collection, storage, processing, and transfer of personal data of individuals in India. Commonly used as an informal reference to the Digital Personal Data Protection Act, 2023, it replaced the older Information Technology Act provisions on privacy. The Act applies to digital personal data processed within India and to data of Indian residents processed outside the country. It introduces obligations for data fiduciaries, rights for data principals, and significant penalties for non-compliance, with the Data Protection Board of India handling disputes. In the Indian context, it is highly relevant for IT companies, startups, fintech firms, and any business handling consumer data. Government departments, educational institutions, and healthcare providers also fall under its scope. The law is frequently discussed in parliament, judiciary, and corporate boardrooms, and questions about its provisions regularly appear in UPSC, banking, and law entrance examinations across India.
