Appeal against Acquittal
Full Form of AGA
What is AGA?
Appeal against Acquittal (AGA) is a legal remedy in Indian criminal jurisprudence that allows the state or prosecution to challenge a trial court's decision acquitting an accused person. Under the Code of Criminal Procedure, 1973 (CrPC), Section 377 empowers the state government to file an appeal against an order of acquittal to a higher court. The AGA is a critical tool to ensure justice, especially in cases where the lower court's verdict is perceived as erroneous or influenced by flawed reasoning. In India, such appeals are heard by the High Court or Supreme Court, requiring substantial grounds to overturn the acquittal since the presumption of innocence is strong. AGA is commonly used in serious crimes like murder, rape, or corruption where public interest demands retrial or conviction. Law students and judiciary aspirants study AGA as part of criminal procedure, and it is a frequent topic in CLAT, AIBE, and state judicial services exams. The process involves obtaining leave from the appellate court before admission, and the appeal must be filed within a specified limitation period.
