What is ICJ?
The International Court of Justice (ICJ) is the principal judicial organ of the United Nations, established in 1945 by the UN Charter and headquartered at the Peace Palace in The Hague, Netherlands. It settles legal disputes between sovereign states and provides advisory opinions on legal questions referred by UN organs and specialized agencies. The ICJ is composed of 15 judges elected by the UN General Assembly and Security Council for nine-year terms. In the Indian context, India has been a party to several ICJ cases, most notably the Kulbhushan Jadhav case (2017–2019), where India approached the ICJ against Pakistan challenging the denial of consular access. The ICJ’s jurisdiction is based on state consent; India accepts the compulsory jurisdiction of the ICJ with certain reservations. The Court’s rulings are binding and final, with no appeal mechanism. The ICJ is frequently featured in Indian competitive examinations such as UPSC Civil Services, law entrance tests, and international relations papers. Candidates must understand its structure, case law, and India’s engagement with the Court. The ICJ also plays a symbolic role as a pillar of international law, reinforcing the rule of law among nations. Despite criticisms of slow proceedings and limited enforcement, the ICJ remains the foremost judicial body for interstate disputes, shaping global legal norms since its inception.
