Duty Under Protest
Full Form of DUP
What is DUP?
Duty Under Protest (DUP) is a customs and excise mechanism that allows an importer or exporter in India to clear goods by paying the duty demanded by customs authorities while formally registering a disagreement with the assessment. This practice is essential when the importer believes the classification, valuation, or rate of duty applied is incorrect but cannot afford to delay clearance due to demurrage or storage costs. By paying under protest, the trader preserves the right to file an appeal or seek a refund later without being penalized for non-payment. DUP is typically initiated by submitting a written letter along with the bill of entry, explicitly stating that the payment is made under protest. This arrangement is widely used at major Indian ports, air cargo complexes, and inland container depots, particularly in high-value or disputed consignments. It also appears in excise duty payments for manufacturing units. For students preparing for CA, CS, or CMA examinations, understanding DUP is crucial as it features in indirect tax law papers and customs procedures. The practice balances revenue collection with the taxpayer's right to challenge erroneous demands, ensuring compliance without sacrificing the trader's dispute options.
