What is ARB?
Arbitration, abbreviated as ARB, is a form of alternative dispute resolution (ADR) where parties agree to resolve their disputes outside of traditional court systems by submitting them to one or more impartial arbitrators. In India, arbitration is primarily governed by the Arbitration and Conciliation Act, 1996, which is based on the UNCITRAL Model Law. This legal framework is widely used for commercial disputes, contract disagreements, construction claims, and corporate conflicts due to its speed, confidentiality, and flexibility. The Act provides for both domestic and international arbitration, making India a key hub for dispute resolution in South Asia. Arbitration is commonly employed in business contracts, infrastructure projects, and trade agreements to avoid lengthy litigation. For law and business students, understanding arbitration is crucial for exams like CLAT, judiciary exams, and company secretary exams.
