What is POA?
Power of Attorney (POA) is a legal document that authorizes one person (the agent or attorney-in-fact) to act on behalf of another person (the principal) in legal, financial, or property matters. In India, POA is widely used for property transactions, banking operations, and business management when the principal is unable to be physically present. It can be general (granting broad powers) or special (limited to specific acts). The document must be executed on non-judicial stamp paper and often notarized or registered, especially for property deals. POA is commonly employed by NRIs (Non-Resident Indians) to manage assets in India, by elderly persons delegating financial decisions, or in corporate settings for signing contracts. It is a crucial instrument in Indian legal practice, reducing the need for personal attendance. For exams like CLAT or judicial services, understanding the distinction between general and special POA, along with revocation rules, is important. The Indian Stamp Act and Registration Act govern its execution, and misuse can lead to legal disputes.
