What is ODR?
Online Dispute Resolution (ODR) is a method of resolving disputes using digital technology, without the need for physical presence in a courtroom. In India, ODR has gained prominence following the rise of e-commerce, digital payments, and the government's push towards a paperless judiciary. It encompasses negotiation, mediation, arbitration, and conciliation conducted through online platforms. ODR is widely used in consumer disputes, commercial disagreements, small claims, and even some family matters. The Indian legal framework supports ODR through initiatives like the e-Courts Project and the recently introduced ODR rules by NITI Aayog and the Ministry of Law and Justice. Courts in metropolitan cities and high courts have adopted ODR for pre-litigation and pending cases, reducing backlog and costs. For competitive exams like CLAT, UGC NET Law, and judiciary services, ODR is a key topic under alternative dispute resolution (ADR) mechanisms.
