What is MHCA?
The Mental Healthcare Act, 2017 (MHCA) is a landmark Indian legislation that replaced the Mental Health Act of 1987. It aims to provide mental healthcare and services to every person in India, especially the vulnerable sections, and ensures that the rights of persons with mental illness are protected. The MHCA decriminalized suicide, decriminalizing any attempt to commit suicide as a result of severe stress or mental illness, and provides for advance directives and nominated representatives. It requires the government to take proactive steps to create awareness, promote mental health, and establish mental health establishments across the country. The Act is implemented by the Central Mental Health Authority and State Mental Health Authorities. It is used by mental health professionals, hospitals, legal practitioners, and patients across India. The MHCA is relevant for competitive exams such as UPSC, state civil services, and healthcare law exams, where questions on mental health rights and recent legislation frequently appear.
