Enforcement of Award
Full Form of EAW
What is EAW?
EAW stands for Enforcement of Award, a legal mechanism under the Arbitration and Conciliation Act, 1996, in India. It refers to the process by which an arbitral award is made legally binding and executable, similar to a court decree. The role of EAW is crucial for alternative dispute resolution, ensuring that parties comply with the arbitrator's decision without needing a fresh lawsuit. In India, after the 2015 amendment, an award becomes enforceable automatically upon expiry of the 90-day period for filing a setting aside application, unless the court grants a stay. EAW is widely used in commercial disputes, construction contracts, and international arbitration involving Indian entities. It simplifies execution by treating the award as a decree of the civil court, allowing attachment of assets, garnishment, or other enforcement measures. For law students and professionals, understanding EAW is essential for exams like CLAT, AIBE, and judicial services, as questions often appear on arbitration procedure and enforcement. The process involves filing an execution petition before a competent court with jurisdiction. EAW promotes efficiency in dispute resolution, reduces court backlog, and strengthens India's position as a pro-arbitration jurisdiction.
