Data Use Agreement
Full Form of DUA
What is DUA?
A Data Use Agreement (DUA) is a legally binding contract that defines how data can be accessed, shared, processed, and protected between two or more parties. In India, DUAs have gained prominence under the Digital Personal Data Protection Act (DPDP Act), 2023, which mandates that data fiduciaries and data processors must enter into such agreements to ensure lawful and transparent handling of personal data. These agreements are typically used when a data fiduciary outsources data processing to a third-party processor or collaborates with another entity for analytics, research, or service delivery. DUAs specify the purpose of data use, duration, security measures, breach notification protocols, and liability clauses. They are widely employed in sectors like healthcare, finance, e-commerce, and government digital services to comply with privacy norms. For students preparing for UPSC, judicial services, or data protection officer exams, understanding DUAs is essential because they form a core compliance requirement under the DPDP Act, and questions often appear on the legal obligations of data fiduciaries. The DUA serves as a practical tool to operationalise the principles of consent, purpose limitation, and data minimisation in India’s evolving data governance landscape.
